Car boot sales

A minimum of one month's notice of intent to hold a car boot sale must be given to the Council. The holding of a car boot sale (a market) without having given the requisite notice may render both the organiser and owner of the land liable to a maximum fine of £1,000 (Section 37, Local Government Miscellaneous Provisions Act 1982).

The only exception to this requirement is where the proceeds are for charitable, sporting or community based organisations and the whole of the proceeds from holding the sale must be applied to the organisation. Only reasonable direct expenses incurred in holding the sale may be deducted.

About this service

Notifications of car boot sales should contain the following information:

• the full name and address of the person intending to hold the sale
• the day or days on which it is proposed to hold the sale
• the site on which it is proposed to hold the sale
• the full name and address of the occupier of that site if not the person holding the car boot sale       

Applicants should also note the Planning department of this authority will be notified by this department of any applications for car boot sales to determine if planning permission is required.
